Won costs from marstons
Hi I won costs from marstons,to be paid by 27 January they never paid sent letters and emails then 14 day notice to pay, got letter off court 8june order amended pursuant to CPR 40.12still stating they are to pay me. Got a letter today from court saying order re-amended CPR 40.12 now I have to pay them what's that about and can I appeal it?? Thanks.

All seems a bit odd - not sure if the slip rule allows the successful party to be switched!
If you could post up the orders with your private info covered it would help, if not can you post what all 3 orders actually say?

You have to file an N244 saying you want to appeal it and why. You were not given notice of the hearing changing the order and there was no error in the original judgment.

Either way, you are out of time to appeal. It's 21 days unless you give a reason why you are late

Yes I was the claimant and the last letter is dated 20 June 3 days ago

They were ordered to pay me, then on the 8june amended order phoned the court and they said they still have to pay me, then got 20 June letter saying re amended now I pay them so confused

Seems to me the original order had the error. Your claim was struck out which means you didn't win. The original order seems to have reversed the claimant/defendant positions in error and Marston's applied for an amendment.
Whichever numpty amended it first time still didn't rectify it and it had to go back again. Looks like you owe Marston's £102.50.
If you brought the claim why didn't you attend the hearing?

I was sick did phone the court to tell them oh well thanks for clearing it up for me
