Bailiff instructs police officer to seize a debtors phone as filming him is a criminal offence but he is allowed to film the debtor, he then goes on to instruct the police to arrest the debtor.

Ironically, I'm drafting a case involving Police as I speak. It was a WPC that put her boot into a door and caught on video. The police CAD entry for the incident had been deleted. The IPCC will be asked to investigate why the CAD entry has been deleted. It involved a car being taken, later sold by Marston.It belonged to the client, and the PCN warrant was her boyfriend's name. They have opted to replace the car and recover the cost from the council. She used it for her business.
I've never seen anyone claiming that filming is a criminal offence. That is a new one.

Another bunch of lame-brained coppers allowing the bailiff to tell them what to do. "You will be arrested" - it's not his decision to make. He used the foot in door manoeuvre, pushed his way past in full view of the police, and still they did nothing. Once again, they take the bailiff's word as gospel.
Dodgeball on the Criminal Procedure Rules - "FMOTL nonsense". Discuss.

This is the end result when police officers are trained by executives from the bailiff industry, talk about your conflict of interest.

The problem here the police took the keys to a car that is not bound goods. The warrant was in the name of the debtor. Police should have checked whose name was on the warrant before threatening an arrest. A nice bill for somebody coming up.
