Regulations need to be transparent on protecting vulnerable persons from civil enforcement. Legislation about vulnerable debtors is convoluted and difficult for typically vulnerable people to follow. It only protects them from enforcement fees. It’s guidelines that recommend creditors to take back control of cases from bailiffs. There is no obligation on creditors and authorities to protect vulnerable debtors.

Regulations do not create the classes of vulnerable people for civil enforcement. It only Paragraph 77 of the Taking Control of goods National Standards 2014 that sets them. Bailiff companies interpret them to their own agenda.

It is unlikely the government will install a statutory regulator for civil enforcement. 90% of enforcement is on the instruction of a government agency or local council. The balance is landlords and county court judgments or High Court Writs. The government has the most to lose by introducing a civil enforcement regulator.

The Beeb is making a short article about vulnerable people and looks to highlight where regulations about vulnerable debtors need to be reviewed. They would like to visit you with a crew to be screened sometime next week during a current affairs program.

what is classed a vulnerable: i as was told i am not.

i am a single parent of a 3 yr old. i am a dyslexic with ADHD, struggling with debt and may lose my home due to housing benefit not paying anything for months even though i am a full time student. i was told only physical disabilities were counted not learning or psychological.

Paragraph 77 of the Taking Control of Goods National Standards 2014 (published by the Ministry of Justice) gives a list of classes of vulnerable people for the purpose of civil enforcement:

  • i) the elderly;

    ii) people with a disability;

    iii) the seriously ill;

    iv) the recently bereaved;

    v) single parent families;

    vi) pregnant women;

    vii) unemployed people; and,

    viii) those who have obvious difficulty in understanding, speaking or reading English.

if you meet this criteria are you protected from fees?

The law says the bailiff may not recover them.
