Hopefully next time the creditor will use a more smart enforcement service.

Johnson lost his case and got over £30K in costs. He is putting it through a bankruptcy. He has no assets. Currently bankruptcy wipes the slate in 6 weeks for a first time bankrupt.

I'm surprised the Judge didn't see that coming because he can get another car and tip it all into bankruptcy and hold the car in a sheltered Ltd company.

Essentially the judge shafted the opponents solicitors and their barrister who will never see any money and are liable for the output tax on their fees.

I assume that means Newlyn's won't see any of their legal costs. Shame.

Mind you, the sight of bailiff's splashing the cash on fancy motors and New York holidays from the pocket of impoverished debtors does rankle....

That was the plan at the outset in Johnson. Stick it through a bankruptcy. He had nothing to lose in pursuing his claim.

Its the last thing Newlyn should be concerned about. I have a queue of Newlyn clients wanting interpleader claims and detailed assessments. I haven't even signed them to solicitors yet. I'll be doing a job-lot over the weekend.
