The practice manager has instructed a solicitor and yesterday, made a section 78 application to set aside the order. It is unlikely to be defended because it is a doctors surgery. A supplier company intends to interplead the leased medical equipment contained therein because the landlord is using the schedule 12 procedure to recover unpaid rent.

No NOE for the goods contained inside. Patient files are exempt, so enforcement is likely to fail on Regulation 4 & 6.
