#1 JBW At Door for dartford crossing

Post by S1231 » 16 Nov 2016 09:16

I had a baliff knocking at my door on Monday with regards to two unpaid fees for dartford crossing. I thought my daughter had paid these but due to family issues etc we've had it was Over looked. I am currently on pip and receive full housing benefit so really don't have spare money! My daughter works but it on a low income. He is saying he wants nearly £500 by Friday or will take the car. I've tried to offer a payment plan with £200 this week and then the rest £200 month ( he's amounted it to nearly £1000!) but he won't accept this. Is there anything I can do???

Two dartford crossings don't amount to £1000 even when the enforcement fees have been added.

The car is in extreme danger. Until you negotiate something, you gotta protect yourself. Here is how: http://www.dealingwithbailiffs.co.uk/Ex ... liffs.html

That will buy you some time. Now run a compliance checklist and see whether there is anything in the legislation you can call on to stop the enforcement or otherwise: http://www.dealingwithbailiffs.co.uk/fo ... p?id=42200

If that does not trump anything useful, then see if any of these apply. http://www.dealingwithbailiffs.co.uk/St ... ailiff.htm
Not a solicitor. I am a paralegal for solicitors bringing proceedings against non-compliant enforcement action.

The penalty charge is £70 and must be paid within 28 days. It’s reduced to £35 if you pay within 14 days and increased to £105 if you don’t pay. You also have to pay the crossing charge.

If the EA is chasing 2 fines, he'll add 2x £75 compliance fee, plus 1x £235 enforcement fee. The maximum at this stage would be £595 (excluding the crossing charge).
