#1 Fees

Post by Jimwardle » 23 Nov 2016 00:01

I was wondering if anyone could answer this for me
Marstons visited me today with a warrant of control the amount was 83 pounds
But with their fees it was 393 pounds
Now my question is can they incorporate there fees onto the warrant or is it separate
Many thanks in advance

It's separate, but he does have a power to take control of goods in respect of them - unless - the original fine is paid to the creditor before doing do.

Once the fine is paid, there is no longer an enforcement power. The warrant ceased to have effect under paragraph 6(3) of Schedule 12 of the Tribunals Courts and Enforcement Act 2007. The fees are owed, but the bailiff cannot take control of goods to recover them.
Run this Checklist. If no joy, then we'll fix it
