#1 Marstons charges are 135% of the debt

Pcn debt £24 , enforcement fee 235, compliance fee 75. Total demanded 408. Add these three it's £333.
Car clamped in my absence. I work away after a recent heart attack. I called original debtor to pay £24 but they refused to accept payment saying I should pay through the bailiff. It seems the consumer has no protection from unscrupulous bailiffs who seem to be the law. After I sort this I am going to volunteer as an advocate for the long suffering cash strapped consumer. Why should a bailiff be paid 75 per visit? I earn 75 per day.
Anyway can you please advice How I can deal with this, can I argue and pay 333 not 408? That is if I cannot pay 24.

The law has fixed the fees regardless of the value of the debt. There is no way round it.

If you are not the debtor, then why is the bailiff pursuing you. You are not liable for other peoples debts. Section 10 of Schedule 12 of the Tribunals Courts and Enforcement Act 2007, states:

  • 10An enforcement agent may take control of goods only if they are goods of the debtor.

I think you need to say who owes the PCN and the date it was incurred and the date you acquired the vehicle.

The debt is mine. However am I liable for 333 or 408?
I had heart attack recently. Pcn incurred in august and part paid.
