Post by Pulsar462bhp » 16 Aug 2017 21:35

Long story short sold car around 18 months ago and got parking ticket same day .

Received letter from council sent them letter and receipt of selling car and never got any responses assumed this matter hado been delt with .

Today received hand delivered letter from Bristow & sutor to property never knocked on door just posted .

Have spoken to council they advised me to speak to court gave me a number and they emailed me a form TE7 and TE9 out of time application form. To which they said they had recived.

Now bailiffs saying will be back tomorrow ( Thursday )

Asking for £423.00 taking control of Goods fees regulations 2014.

I have never been to court
I have never received any other letters from before.

Where can I find a template to send these or as much advice as possible be very grateful.

Kind regards
Paul

What date (roughly) did you complete the TE9 and TE7 forms?

If more than six weeks ago, then tomorrow, call the Traffic Enforcement Centre 0300 123 1059 (press 6 to skip robots) and when answered, give the PCN number. Ask the outcome of the appeal.

You should have received other documents by post. Run the Traffic Debts enforcement compliance check.

Enforcement is suspended until the outcome of the appeal.

If you have not already done so, add evidence of the sale of the car, bill of sale, advertisement, the flow of money showing the TIME of the transaction. It will strengthen your appeal. Be quick. You cannot add this after the appeal has been decided.

Email it to tec@hmcts.gsi.gov.uk reference your PCN number.

Unfortunately all I have is a ebay advert but it sold out of eBay to a cash buyer.

Was only cheap car £600.00 they paid cash and all I did is hand written receipt paid in cash no warranty sold as seen both parties signed.

What can I tell the bailiffs if they come tomorrow as they originally wanted to .

My partner and small child are at home alone my partner under hospital treatment tomorrow for miscarriage and would rather her not have the stress of this .

The bailiff won't return. The enforcement power was suspended when you emailed the forms. Paragraph 8.1 of Practice Direction 75.

Copy of the eBay advert you do have must to be given with your appeal.
