You don't want the CAB advisor, you want someone with a bit of clout. Have you tried your local councillor?

Yes I thought that too why have they passed me onto CAB. CAB is first port of call. MP last :(
I actually have a friend who's one of the local councillors but she deals with roads, parks etc not things like this. I will speak to her though she only lives a few doors down from me.

I didn't see that Jason had put add to complaint under the single parent vulnerability so I will do that as well as add it into bailiff letter and email.

This is what I had back from Wales Enforcement (port Talbot justice centre)

Further to your E-mail re your outstanding fine



I have to advise you once again that this office is not allowed to interfere with the Distress Warrant once correctly issued to the bailiffs for non payment of a fine.



I would advise you to contact them on 0845 074 3749 to discuss your proposals for paying them.

He called again today. I wasn't home again, neighbours are watching him. Knocked like a child at a sweet shop, sat in his van for 5 minutes then reversed van further onto drive (no idea why) sat there a further 5 mins and drove off.
No letter or card through door or anything! Possibly as last one said "coming back with a locksmith and police" he can't really post the same through again as he would look stupid! Never heard of them not leaving a letter/card.
If my street weren't looking out for him I wouldn't of even known he had been!

They are obviously ignoring my letters regarding applying to court for re-test of means as well as being a vulnerable person.

My housing association have also been made aware and are very annoyed. This is their property and not mine.

MP is involved and disgusted at the court service as she has seen all of my receipts of payment and enforcement should not be even involved not when only one payment was late and the court was notified of the change in circumstance since being fined.

Still nothing back from the courts about a hearing but I didn't expect to receive a response as they didn't respond when notifying them of change of circumstances in October!

It's frightening my little girl she can see the worry in her mummy's face everytime the doors knocks, children aren't stupid, our lives are on hold because of this "creature" she has a heart condition and is not to be put under stress. I am trying my best to remain calm for her sake. The fine is almost paid off and being paid off every week. I am not refusing to pay, I just cannot in one lump sum.

Will it ever end?!

Your MP is the only one who can go in there and intervene. Court Service is trying to go behind section 85 of the Magistrates Courts Act 1980 and Regulation 12 of the Taking Control of Goods (Fees) Regulations 2014.

Yes she's on the case thanks Jason! I'm appauled with the courts for treating people this way and so is she! Apparently she's had numerous complaints about them and bailiffs recently. Bullying people to pay more than they can afford is disgraceful and makes them default on other essential bills. It doesn't help anyone but the greedy thugs that frighten the life out of people. Obviously those who have a history of not paying or regularly pay late then I understand to some extent but not people who do pay and have never refused to pay :(

Hi guys so it's been a while! On Tuesday I got out of the shower and 2 bailiffs were in my living room!!! They had gone around the back unlocked the gate and walked in through the patio doors. I have no issue with that as the door was unlocked and they aren't horrible men but about 2 hours before they came I was on the phone to the fines place asking for a balance. She said nothing about the bailiffs so assumed they were history she even said im classes as green I asked what she meant and she said your reliable with payments. The bailiffs could clearly see I have nothing. Couldn't touch car as on finance but he listed my broken 32" tv, tv cabinet, sideboard (completely broken covered in child's paint) sofa also broken armchair broken and thread bare, footstool (stained and covered with throw) and my daughters wii and neighbours Xbox 360. Don't care if he takes all of this as it's all broken anyway but why would he when he isn't even going to get £50 for all of this stuff! He asked me to call him by noon today I told him I can't I don't have a home phone or a mobile how the hell could I manage to run a phone!!! Every single week since last year I've gone without food for a few days to make sure I can pay the £12.50 every week and then he says I have to pay £700! Courts obviously ignored my change of circumstance request which I expected although I've contacted the MP again as a matter of urgency now. After they left on Tuesday when my neighbour got home I asked her if I could text him from her phone I just said I cannot have this hanging over my head not when I could possibly have leukemia (not diagnosed yet takes ages just a possibility) and with my little girl going in for a heart operation today so just come Monday or Tuesday (they told me they would come back at a convenient time for me) and collect the stuff as there is no way I can raise this cash. When they were here I told them I had used all of my sons savings to pay excel bailiffs £980 recently, he asked what did excel put on goods agreement I said car and tv. I don't know why he asked that but I was explaining I've already used up any money I could borrow I don't have anyone who can pay this one too. I would even go down the payday loan route but i wont get accepted. What I'm worried about is he said he could take this stuff and it won't hardly touch the debt owed then I will have more bailiffs coming for the rest owed but how can they as I'll have a bare house then?? This has to be stopped! No wonder people kill themselves! It's like the courts just want all fines cleared and off the books it should not happen to people who pay the fines I have paid what the court ordered me too so what changed?!

Bailiffs won't get anything for it. Chattels are worthless now. They only want the car but they discovered that's not available.

Have your doctor complete a MALG evidence form. Give completed copies to the court and to your MP.

Bailiffs should not be pestering someone in your circumstances.

Ok so report a breach of section 85 of the Magistrates' Courts Act 1980 to the MP? And of course I'll take part in the documentary! Will email you shortly, thank you. If I can help at least one innocent person to not go through this then I will be happy! I'm also in court on 8th may because my housing association wants all tenants who are in receipt of housing benefit to pay up a months rent in their account due to councils paying 4 weeks in arrears. That is my main worry here not these bailiffs. They should not be adding more stress especially when people do pay their fines, they assume people are only dealing with them and nothing else. Material items mean nothing to me!
There should be some protection put in place for single parents and situations like this, it's pretty disgraceful.

Marston is a commercial business. It doesn't give a stuff about peoples well being. It just wants money in their pocket.
