To cut a long story short I got fined for not having a tv licence pleaded guilty by post to the courts had a bailiff letter in January I emailed them asking to take it out of our benefits heard nothing back until Tuesday where a letter was delivered a removal letter I rang the mobile
Number of the bailiff on the letter he basically said I had to pay £500 I said we simply can't afford it offered to set up a payment plan he refused he said to do that he will send it back to the courts but because I'm already on a suspended sentence for the same thing (plus unpaid court fines) which are now all paid he said the judge won't be as easy on me this time he's give me until Friday to pay £500 I have been to see Citivans advice yesterday I have a debt appointment on the 9th may my question is how can I avoid this as I don't want to go to court and what can Citivans advice do

Citizens advice is a government operation and only gives advice to their agenda. It's like seeking advice from an opponents solicitor!

The bailiff is from high court enforcement

I haven't been means tested (the bailiff said to do this I would need to be sent to court)

I'm a vulnerable person my partner is currently under the mental health I care for him

High Court does not recover unpaid court fines. They recover writs of control.

It will be Marston Holdings Limited. If you need more time to pay the fine, then you can make an application at court. It's a simple process. Here is how its done. http://www.dealingwithbailiffs.co.uk/Pa ... lments.htm

It gets the bailiff off your back and the £310 fees disappear.

Being a vulnerable person doesn't make you exempt from enforcement, you are only exempt from fees and costs of enforcement.

Bailiff companies do not normally adhere to the law unless an MP or solicitor intervenes.

The fine is from HM Cheshire court it says on the letter it's marsdons rings on behalf of HM court
Would I need to go to court to set up a payment plan the bailiff refused

Yes. Go before the JP. Don't get fobbed off with court staff. Its your statutory right.

What if I paid the courts the £190 they are chasing me for I could do that online I have my account number but no division number what will marsdon do then

Marston will pursue you for their fees. They will even threaten you with breaking entry under a pretense the enforcement power continues after the sum adjudged has been paid.

But I won't owe money to the courts then so in theory I can't go back to court for not paying the court fine? It will just be marstons fees? How do I find out division number

Phone court service and ask them. Record the call using an app. ACR Pro is only £2.49. Ask for the name of the person you are speaking to.

If you don't have the Notice of Fine, then it's probably a fine you don't know about. You will have to make a section 14 statutory declaration because the bailiff action failed because the Notice of Enforcement did not give sufficient information to enable you to identify the origin of the debt. Attach a copy (if you have one) to your statutory declaration.

Thank you I will call the courts tomorrow and ask for the division number so I can pay the fine will they still let me pay it online or over the phone the courts money (£190) with it having gone to marstons debt recovery?

They won't let you pay it over the phone. They will say contact the bailiffs. They might say they gave public money to the bailiffs so they can apportion it under a pretense it is proceeds of the sale of controlled goods.

You will get a RETMAR letter sent through the post. File it appropriately.

This is so stressful
I emailed the court yesterday asked them if I could Paul he £190 that I owe them they habe wrote back and said this

Hi, did you get your division number ?
I had the same, got my division number and paid the fine online and got a receipt, if you pay online they can't refuse it.
The court told me exactly the same thing.

I believe that each court has there own division number and it's Warrington court so the Cheshire and Merseyside Central Code I need

I text the bailiff and I said I can pay £100 then £20 every week and said I have been to citizens advice and they said I'm a vulnerable person as I have children and I care for my partner who is under the mental health team and he has just txt me back saying this

I'm afraid you've been given bad advice by CAB as your circumstances do not constitute vulnerability. I'll come round over the next few days to assess assets for seizure.

It's not up to the Bailiff to assess the vulnerability of a person, that's down to the court, he doesn't have the right.
He will try and pester you, he knows your worried.
I was the same, until I got advice from this forum.
I stood my ground as I paid mine fine online.
They are gunning for fees but as Jason has said before,
The fees maybe owed, but he can't use the warrant to obtain them, technically it's a civil dispute between me and them.
He will try and scare you, be strong.
