Post by Ldj1982 » 18 May 2017 15:54

Just had an enforcement letter arrived from an outstanding debt to a solicitor due to divorce. A CCj was issued and then thi letter. I owe £7000 and don't have the monies to pay. I called the company HCE and they said I need call on the 26th to make an appointment for the officer to visit. What can I do

You do not "make an appointment" for a bailiff to visit. Their motive is to apply thousands of pounds in attendance charges.

You must apply to stay the writ of execution and vary the judgment to an amount you can afford. Without that, you will be royally screwed over by HCE Group.

Here is how to apply to stay a writ and vary the original judgment. Do not tell the bailiff you are doing this. http://www.dealingwithbailiffs.co.uk/St ... r-HCEO.htm

Also, do a fact-find and see if there is any irregularity with the enforcement: http://beatthebailiffs.org/Stop-a-high- ... ficer.html

What happens if they do seize goods but doesn't clear the debt as I have no valuable goods amount to £7000 let alone a few hundred

You don't have to let them in, but anything of value outside (ie a car) would be at risk. Applying for a variation is very straightforward.

Apply for a variation is the ONLY way to go with this.

Yes, to file the application, but you can opt to have the judge consider it without a hearing. You have been 150% accurate with your form N245 income and expenditure and back it up with evidence of income and outgoings.
