#1 trust online search not showing warrant of control

Would a warrant of control judgement show up on trust online? I cant see anything apart from another ccj I'm dealing with. I've searched ccj, high court and fine defaults with the address verbatim as previous HMTCS communications.

What's going on?

You can't see if a warrant has been issued online. You'd have to contact the court.

Trust online shows CCJs as long as they are less than 6 years old. However, CCJs are not the only debts warrants can be issued for. Trust online doesn't show what action has been taken to enforce the CCJs either.

strange update on this one.... got through to someone quite nice at the court, who broke the payments down for us.

The £110 we paid via allpay card has been split £98.16 to collectica and the remaining £11.84 has remained with the account.... so court retained 10% ish.

I would say that you need to ask them under what legislative authority they have split the payment - fees can only be collected from the proceeds of enforcement that have been taken using the schedule 12 procedure. A direct payment has not been collected in this way. If it has been split due to a private contract between HMCTS and the bailiff then ask to see where you have agreed to your money being apportioned in this way.

Like I say, I would say you need to ask them, but they won't have a clue. They're just following orders.

That is my plan Mr.Pote. I've done a n245 and asked for a suspension. I did a 245. Because from what I read they are far less likely to refuse it. Whilst that is in place ill do a 244, and ask to get it set aside, hopefully splitting the fine into court fine and any fees they may still try and apply. I assume the fees are a civil matter and not part of the criminal fine? I'll then try and attach them to an ever growing DRO... there is a lot she hasn't told me.
If i can get it put back in court, ill produce the receipt from hmtcs for the sum adjudged and say its been paid.
If they reject, I will ask for the legislation that allowed them to pass on the monies to collectica. Funny split though eh? 90/10? There must be a contract between these buggers to which I have not signed?

How does that sound? Am I on right track?

Ps Marston bailiffs on noe, money paid to collectica. I know its the same group, but can they do that?!
