An enforcement agent may take control of goods only if they are goods of the debtor, Paragraph 10 of Schedule 12 of the Tribunals, Courts and Enforcement Act 2007.

I've received a letter today to say their coming tomorrow's with removal contractors

Ok, as said on the other thread, this is for Southern Water.

First thing, there is no forced entry for this kind of debt and you don't have to meet with the bailiff. These kind of letters play on people's ignorance of the law. However, anything of value outside the property in your name such as a car, caravan, etc is at risk and needs to be put somewhere safe. There are exemptions such as a car with a blue badge displayed or a car on HP.

Were you aware of the debt before this letter? Did you receive notices from the court and Marston's? Did you attend court? Do you accept you owe this debt? What was the original amount before Marston's became involved?

I'm not sure as I have not received any letter from southern water and I've received one hand delivered letter before this letter

So you've had nothing from the court - no defence pack, no judgement letter?

You've had nothing from Southern Water at all prior to this? Were you even aware of the debt? Is the debt yours? You need to give us all the info you have so we can advise accurately.

No I live in block of flats and have always had trouble with mail as they say they can't get in sometimes and the buzzer has just been repaired after being broken for 4 months so everybody in the block has had mail missing for ages when I do get mail it's never a lot just junk mail

Ok - the bailiff is hardly likely to get in then is he? Do you have a car/bike etc outside?

Do you owe Southern Water any money? Like I said, you need to give as much detail as possible, a full history of what you know about this debt.
