PARKING CONTROL MANAGEMENT
PARKING CONTROL MANAGEMENT
I was ticketed in Colindale by a private firm outside Sainsburys won of there smaller stores. The signs for no parking was so high up they could not be seen.I was in Sainsbury for just 3 minutes just to buy some butter.
They are not members of Poopla or the British parking association so I had no redress there.
They have issued a court claim and it has just been passed to Clerkenwell & Shoreditch court, still awaiting a time when I am to go.
Any help or suggestions please come back to me.

Hello Tuttsi, long time no speak.
Who is the company who ticketed you? How long do they claim you overstayed by?

Complete the defence response pack by ticking the box that you intend to defend the whole of the claim
When the claim has been listed, make a witness statement saying you don't know who was driving the car.
The claim fails.

Lol - Poopla. Sorry, can't resist sometimes.

Re: PARKING CONTROL MANAGEMENT
Hiya Amy
The company was Parking Control Management, they do not say how long I overstayed. They photographed my car and sent the ticket in the post.
However I was only in Sainsbury's for 3 minutes.

I should have paid more attention to the title! Been watching the rugby (that's my excuse...!)

Hi Jason
It is past this stage now, I am just awaiting a court hearing. I have said that this claim will be defended.
They said to change any details it would cost £100.

Re: PARKING CONTROL MANAGEMENT
You don't need to change anything. You admit you are the registered keeper, but you don't know who was driving it.

Is it right that this forum is supporting perjury?
Tuttsi said they were driving the car yet the advice is to claim that you didn't know who was driving?

I am not sure what you mean but I have been a lurking member on here for 6 months although not often posted.
You didn't answer the question though
Are you suggesting that Tuttsi commits perjury ?
I know many people do and get away with it but some also get caught out - not very professional to suggest it in public.

Perjury is lying to court while on oath. That's not what I suggested.

Re: PARKING CONTROL MANAGEMENT
Anyone with legal training or law degree would never advise committing "Perjury" or telling anyone to "Pervert the Course of Justice" the outcome can have dire consequences to say the least.
Interpretation of the facts is a different matter all together, you can tell the truth just giving minimal information.

Re: PARKING CONTROL MANAGEMENT
Good job he didn't advise committing perjury then.
Re: PARKING CONTROL MANAGEMENT
I've seen EAs commit perjury alright..that's why they are no longer as such, the ones I've dealt with anyway. And serves them bloody right. Their days are gradually over, those lying through gritted teeth just to get their commission? Throwing their toys about at all and sundry. Over zealous sense of power and authority? Power mad frankly.
It is morally repulsive and wrong. It doesn't belong in a so called civilised country. Things SHALL change. Get over it.

Re: PARKING CONTROL MANAGEMENT
It's a matter of common sense, you don't need a law degree to know you shouldn't suggest shoplifting or dealing drugs to someone with debt problems, because they are illegal, just as what you mention above.
Indeed, keeping information to yourself is not quite the same a lying.
Listen very carefully, I shall post this only once:

Sadly its a well known fact that EA's cannot tell the truth, they must have special training or believe the law does not apply to them.
We all know they are a special breed, a special breed of R Soles!

Re: PARKING CONTROL MANAGEMENT
During a magistrates court trial, my client stood accused of interfering with controlled goods. The bailiff said on oath in cross-examination he had previously worked for the Sheriff's Office for 16 years.
No prizes for guessing where he ended up. The irony is Peter "Bailiff-can-take-your-hire-purchase-car " Felton-Gerber is now defending him.

Amy, not quite sure why the animosity but you are I'm afraid slightly misguided. If you're unhappy for any reason then please say so via pm (And it is not the first?) I have for some reason had same before.
Age? Age is immaterial no apologies but. Facts on the other hand often count and there are quite a few who are beginning to ask questions. Nothing personal and I've never ever had a dig at anyone including yourself Amy. Hope you see where I'm coming from perhaps.

Re: PARKING CONTROL MANAGEMENT
I apologise if i said anything out of turn , my instinctive reaction was that Tuttsi was being told to say that although they owned the car they didn't know who was driving it. As they had already admitted it, it struck me as telling lies in court which was to me perjury however not having experience of this type of thing I may be wrong

I do see where you're coming from and I am not unhappy. Far from it actually because England just won the 6 Nations (again), trounced Scotland (again), won the Calcutta Cup (again) and next week if they win again, it will be record breaking.Edd wrote: ↑11 Mar 2017 21:18Amy, not quite sure why the animosity but you are I'm afraid slightly misguided. Re: PARKING CONTROL MANAGEMENT
Out of turn? Maybe more are perhaps realising that private companies et al are continually becoming a nuisance with their OT agenda, I.e., ripping ordinary folk off? Those put in place to do the 'dirty' also found out? Wardens with a uniform and misplaced sense of authority.Tony72 wrote: ↑11 Mar 2017 21:33I apologise if i said anything out of turn , my instinctive reaction was that Tuttsi was being told to say that although they owned the car they didn't know who was driving it. I seem to recall or when none of this frankly nonsense had any place or when common sense dictated. Things carried on as normal. Overstaying your parking? We have moved on massively since in terms of technology, but this mindset belongs in the Stone Age. This is the 21st century and whilst this is nothing personal to yourself and perhaps generally speaking, anyone with an iota of decency and common sense would more than likely agree..this big fine malarkey stinks. Ordinary people made to feel like crims? Villains?
No more a villain than say a bod with a ticket machine prepared to give them out like smarties. All under the guise of doing public duty? Complete utter rolocks. Waiting in vain to pounce? A vile industry through and through.

Re: PARKING CONTROL MANAGEMENT
I treat everyone as equal, don't proclaim to break forum rules. Don't intend to go off topic either so maybe best left there?
Otherwise it starts to look a tad unwelcoming. And slightly unprofessional. Would never say for eg "you have been warned" because that would be taking the biscuit so am going to refrain. Still a tad confused by your stance, but never mind eh.

Re: PARKING CONTROL MANAGEMENT
Tuttsi, I don't understand what they are prosecuting you for given you were only in Sainsbury's for 3 minutes.
What does the claim actually state?
What does the claim actually state?
Re: PARKING CONTROL MANAGEMENT
The claim states that I parked on a piece of private land, This piece of land is off the public highway and it is marked out for Sainsbury express deliveries. However, I was only there for under 3 minutes, I literally parked ran into Sainsbury picked up the butter and paid and went straight back to my car. No ticket was ever put on my windscreen. It came in the post and I said I would argue it as it appeared that the signs were over 6ft high to the bottom of their sign which I did not see it. I have taken my friend along who is into photography and he has given to me photo's of the sign with people walking under the signs which was well above their heads.
I requested from them to supply evidence that this was a private parking area and they have failed to give this to me.
Now some more signs have been put up lower down, but that is too late for them now against me as I photographic evidence of how it was.
